| Sales terms
1. Following sales terms apply to all orders, unless otherwise and expressly agreed by the parties. Any other disposition shall not be considered.
2. Prices
Our prices are to be understood ex-works, freight, packing and insurance not included. In formulating our offers, prices are set according to quantities required. lf the number of pieces is reduced on order received, the prices will be modified accordingly. Minimum billing charge: according current tariff. Shipments are invoiced according the price list in force.
3. Special execution
By ordering special items, the quantity delivered is according to the result of fabrication.
4. Shipment
Shipments are performed at customer's risk.
5. Payment
Payment: 30 days net. Any delay in payment cancels our delivery commitment or any other obligations.
6. Cancellation
Cancellation of orders does not free customer from his obligations for work already performed or in process. All tooling cost will be invoiced.
7. Claims
Each product leaving our premises is guaranteed regarding manufacture, quality and accuracy. Any defective item in manufacture duly verified, shall be replaced free of charge. The warranty covers the mere replacement of items incriminated only. Other compensations shall not be considered. Possible damages due to natural wear, incorrect or abusive use, or part modifications, made by third party, are not covered. Any claim regarding quality or quantity must be made in writing within I days after receipt of goods. No claim will be considered after this period of time.
8. Jurisdiction
All legal actions concerning or deriving from this contract are subject to Courts in Moutier, for both parties.
9. Drawings and models
Without our express consent in writing, no drawing plan or model can be handed to third party, nor can they be used in own manufacturing.
10. Notice
For models not included in our catalogue, detailed drawing or sample must be sent with purchase order.
